1 – PURPOSE

These General Terms and Conditions of Sale apply without restriction to all online sales offered by BALC (the "Seller" or "BALC") on the website https://balc.shop (the "Site"). They define the terms and conditions of online sales and delivery of products, as well as the rights and obligations of the parties.

By placing an order, the buyer ("Buyer") fully and unconditionally accepts these terms. These terms prevail over all other general or specific conditions not expressly agreed to by BALC.

3 – LEGAL CAPACITY AND ACCEPTANCE

The Site is accessible to any natural person with full legal capacity, or to any legal entity represented by a person with authority to contract on its behalf. Acceptance of these terms is indicated by a checkbox in the order form.

4 – PRODUCTS

Product characteristics are available on the Site before any order. Products are offered for sale within the limits of available stock. BALC makes every effort to ensure photographs and descriptions accurately reflect the products. Minor color variations shall not constitute grounds for liability.

5 – ORDERING

The Buyer selects their chosen product and places it in the cart. The order is considered received by BALC once definitively validated by the Buyer. A confirmation email summarizing the order details and expected delivery time is sent upon checkout. The Buyer must ensure their contact details are correct.

6 – PRICE AND PAYMENT

Prices are displayed on the Site inclusive of applicable taxes. BALC reserves the right to offer promotional discounts at its discretion. Shipping costs, if applicable, are shown before order validation. The applicable price is the one displayed at the time of the order.

Full payment is required at the time of ordering. Payment is accepted online by credit card via Shopify Payments. BALC reserves the right to suspend or cancel any order in the event of non-payment, payment incident, or fraud.

An invoice is sent by email to the address provided at registration.

7 – DELIVERY

Delivery is made to the address indicated at the time of ordering. Different delivery methods may be available depending on the product and its weight. Delivery options, times and associated costs are communicated before order validation. BALC commits to delivering products within a maximum of 20 business days from the order date.

The Buyer is solely responsible for ensuring delivery information is correct and for collecting delivered products within the required timeframe. In the event of error due to incorrect information provided by the Buyer, BALC cannot be held liable.

8 – RIGHT OF WITHDRAWAL

The Buyer has 14 working days from the date of receipt of the ordered products to withdraw without giving any reason and without paying any penalty, except for return shipping costs which remain the Buyer's responsibility.

To exercise this right, the Buyer must notify BALC in writing (by email or using the withdrawal form below) before the deadline, and return the products within 14 calendar days of notification. Products must be returned in their original packaging, unused, unwashed, undamaged, with original tags attached.

The Buyer will be refunded within 14 days of BALC's receipt of the withdrawal request, less any return shipping costs. BALC reserves the right to delay the refund until the products have been received.

9 – LEGAL WARRANTIES

The Buyer benefits from legal warranties of conformity and against hidden defects. In the event of a defect, non-conformity or damage, the Buyer must contact BALC at hello@balc.shop, describing the issue and providing supporting documentation (photos). BALC will arrange and cover the return shipping and will replace or refund the product as appropriate within 14 days.

10 – BUYER OBLIGATIONS

Buyers are solely responsible for selecting and using the products and must verify their suitability for their specific needs before purchasing.

11 – BALC LIABILITY

BALC's liability is excluded in cases of indirect damage, force majeure, or damage caused by the Buyer's negligence. BALC's liability is expressly limited to direct, proven damages suffered by Buyers.

12 – INTELLECTUAL PROPERTY

All systems, software, databases and content on the Site are protected by intellectual property law. Any reproduction or use without BALC's express authorization is strictly prohibited.

13 – PERSONAL DATA AND NEWSLETTER

BALC's data protection practices are described in the Privacy Policy available on the Site. By ordering, the Buyer consents to the collection and processing of their personal data for order fulfillment purposes. The Buyer may unsubscribe from marketing emails via the unsubscribe link in each email.

14 – MODIFICATIONS

BALC reserves the right to modify these terms at any time. The applicable terms are those in force at the date of the Buyer's order.

15 – GOVERNING LAW AND JURISDICTION

These terms are governed by French law. In the event of a dispute, the courts of Versailles shall have exclusive jurisdiction, unless mandatory procedural rules provide otherwise. Alternative dispute resolution is available via the CM2C mediation service at https://www.cm2c.net/ or via the European Commission's online dispute resolution platform at http://ec.europa.eu/consumers/odr/.
